Welcome to Boland Cellar (“Boland Cellar”, “we”, “us” or “our”).
By accessing or using the website bolandcellar.co.za (the “Site”) and purchasing any products from us, you agree to be bound by these Terms and Conditions (“Terms”) and all policies incorporated by reference, including our Privacy Policy.
If you do not agree to these Terms, you may not access or use the Site or purchase any products from Boland Cellar.
Boland Cellar reserves the right to amend these Terms at any time. Any changes will be posted on this Site and the “Last updated” date will be revised accordingly. Continued use of the Site constitutes acceptance of the updated Terms.
1. Privacy Policy
Please refer to our Privacy Policy for information on how we collect, use and protect your personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA).
2. Eligibility and Legal Drinking Age
The Site and our products are intended for use by persons who are legally permitted to purchase alcohol.
By using this Site, you represent and warrant that you:

are 18 years of age or older;

are a legal resident of South Africa;

are purchasing wine for personal consumption and not for resale unless agreed in writing;

have the legal capacity to enter into binding agreements; and

will not provide alcohol to persons under the age of 18.
Boland Cellar reserves the right to refuse service or cancel any order if we reasonably believe these requirements are not met.
3. Registration and Account Responsibility
To place an order, you may be required to create an account.
By creating an account, you agree to:

provide accurate, current and complete information;

keep your login details secure;
-
be responsible for all activity under your account; and
-
notify us immediately of any unauthorized access or security breach.
We reserve the right to suspend or terminate accounts that breach these Terms or applicable law.
4. Communications
By creating an account or placing an order, you consent to receive electronic communications from Boland Cellar relating to your orders, payments, and account.
We may also send marketing communications. You may opt out of promotional emails at any time by using the unsubscribe link provided. Transactional communications will still be sent where necessary.
5. Governing Law and Jurisdiction
These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa.
You consent to the exclusive jurisdiction of the South African courts in respect of any dispute arising from these Terms or your use of the Site.
6. Terms of Sale
6.1 Product Information
Boland Cellar sells wine products through the Site. All product descriptions, images and prices are provided in good faith but may be subject to correction if errors occur.
We reserve the right to:

limit quantities per order;
-
discontinue products at any time;
-
refuse or cancel orders at our discretion.
6.2 Pricing and VAT
All prices are displayed in South African Rand (ZAR) and include Value Added Tax (VAT) at the applicable rate.
Prices may change at any time without prior notice. The price charged will be the price displayed at the time your order is placed and confirmed.
Delivery charges, if applicable, will be displayed separately at checkout.
6.3 Payment
By providing payment details, you confirm that:

you are authorized to use the selected payment method; and
-
you authorize Boland Cellar (or its payment service provider) to charge the full amount of your order, including VAT and delivery charges.
If payment is declined or reversed, your order may be cancelled.
6.4 Availability
All products are subject to availability. If an item is unavailable after you have placed an order, we will notify you and offer:
-
a refund, or
-
an alternative product of similar value, subject to your approval.
7. Delivery
Delivery is available within South Africa only.
Delivery times are estimates and may vary due to circumstances beyond our control.
Risk in the goods passes to you upon delivery to the address provided. You or an authorized adult (18 years or older) must be present to receive delivery.
Boland Cellar reserves the right to request proof of age upon delivery.
8. Returns and Refunds
In terms of the Consumer Protection Act (CPA):
You may return unopened and undamaged products within 7 days of delivery if:
-
the product is incorrect;
-
the product is defective; or
-
the product is damaged in transit.
We do not accept returns of opened bottles unless the wine is proven to be faulty (for example, corked wine).
Refunds will be processed within a reasonable period after inspection of the returned product.
Delivery costs may not be refundable unless the return is due to our error.
9. Responsible Alcohol Use
Boland Cellar supports responsible drinking.
By placing an order, you confirm that:

you will not supply alcohol to persons under 18;
-
you understand alcohol consumption carries health risks;
-
you will consume responsibly.
10. Intellectual Property
All content on this Site, including text, images, logos, and trademarks, belongs to Boland Cellar or its licensors and may not be copied, reproduced, or used without written permission.
11. Limitation of Liability
To the maximum extent permitted by law, Boland Cellar shall not be liable for any indirect, incidental or consequential damages arising from your use of the Site or products purchased.
Nothing in these Terms limits rights granted to consumers under the Consumer Protection Act.
12. Force Majeure
Boland Cellar shall not be liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, transport disruptions or system failures.
13. Competitions and Promotional Offers
From time to time, Boland Cellar may conduct competitions, giveaways, or promotional campaigns (“Competitions”). Each Competition will be governed by these Terms and any additional specific rules published for that Competition.
Unless otherwise stated, the following rules apply:

Proof of in-store purchase is required to enter any Competition.

Competitions are open to persons aged 18 years and older only.
-
“Wine for a year” refers to one six-bottle case of Boland Cellar wines, selected at the sole discretion of Boland Cellar, delivered monthly for a period not exceeding 12 months.

Delivery of Competition prizes is limited to addresses within the Republic of South Africa and will take place during office hours, Monday to Friday between 08h00 and 17h00.

Prizes are not transferable and may not be exchanged for cash.

All decisions regarding winning entrants are final and made at the sole discretion of Boland Cellar management. No correspondence will be entered into.

Boland Cellar reserves the right to disqualify any entrant who breaches these Terms or engages in unlawful or fraudulent conduct.

Boland Cellar reserves the right to amend, suspend, or terminate any Competition at any time if required by law or due to circumstances beyond its control.
14. Discounts and Promotional Pricing
Boland Cellar may offer discounts, promotions, or special pricing from time to time.
All discounts:
-
are valid for a limited period only unless otherwise stated;
-
may not be combined with other promotions unless explicitly specified;
-
apply only to selected products or categories as advertised;
-
are subject to stock availability; and
-
may be withdrawn or amended at any time without prior notice.
Discounts have no cash value and may not be exchanged or transferred.
Boland Cellar reserves the right to refuse the use of any discount or promotional code where abuse or misuse is suspected.
15. My Boland Wine Club Membership
15.1 Membership Eligibility and Term
My Boland Wine Club membership is valid for a period of 12 months from the date of qualification.
To qualify, a customer must spend a minimum of R1,200 per year on Boland Cellar wines. Membership status is reviewed annually to determine continued eligibility.
Boland Cellar reserves the right to approve, revoke, or decline membership at its sole discretion.
15.2 Member Benefits
My Boland Wine Club members receive the following benefits:
-
15% discount on all Boland Cellar wines for the duration of their membership period;
-
Exclusive access to partner benefits, which may include discounts, promotions, and giveaways offered by third-party partners;
-
Exclusive access to selected older vintages, which are available only to My Boland Wine Club members.
Partner benefits are subject to availability and may change from time to time. Boland Cellar is not responsible for the quality, availability, or performance of third-party partner products or services.
15.3 Older Vintage Wines
Older vintage wines are sold on an as-is basis and are made available exclusively to My Boland Wine Club members.
Due to the nature of aged wine, Boland Cellar does not guarantee the condition, quality, or drinkability of older vintages. By purchasing older vintages, members acknowledge and accept the inherent risk associated with mature wines.
No refunds or replacements will be provided for older vintage wines unless required by law.
15.4 Membership Communications
Members may receive communications relating to:
-
exclusive offers;
-
competitions and giveaways;
-
partner benefits; and
-
older vintage releases.
Members may opt out of promotional communications at any time, however this may limit access to certain membership benefits that require communication for participation.
16. Changes to These Terms
We may update these Terms from time to time for legal, operational or regulatory reasons. Updated Terms will be posted on this Site with a revised “Last updated” date.
